注销前税务准备
小规模纳税人在注销税务登记之前,需要先完成当期的纳税申报。这包括增值税、城市维护建设税、教育费附加、地方教育附加、印花税等各项税费的申报。例如,如果公司有购销合同,需要对印花税进行申报结算。
清理发票。需要将未开具的空白发票进行缴销,具体操作是在税控设备中对空白发票进行作废处理,携带税控设备、空白发票以及发票领购簿等相关资料到昌平区税务局办税服务厅办理发票缴销手续。
清算税款。税务机关会对公司的纳税情况进行检查,查看是否存在欠税、漏税等情况。如果有欠税,需要及时补缴税款、滞纳金以及可能产生的罚款。例如,若公司未按时申报纳税,可能会产生滞纳金,应按照规定的比例进行补缴。
税务注销流程
纳税人可以通过北京市电子税务局提交注销税务登记申请。在电子税务局首页,找到 “套餐业务 - 清税注销套餐”,点击进入后按照系统提示填写注销原因、经办人等信息。系统会自动进行指标校验,对于可在网上办理的事项,如未申报记录等,会提示 “网上办理”,纳税人可直接点击跳转办理。
如果存在强制类未办结事项,如欠税未缴清等情况,需要先办结这些事项。纳税人可以打印未办结事项清单,根据清单内容逐一处理。处理完毕后进入注销预检,若没有未办结事项,且满足即办资格,可直接在电子税务局点击 “申请注销”,系统将自动完成税务注销,并生成清税证明,纳税人可以下载打印。
若不满足即办资格,如存在未处理的税务违法违章记录等情况,需要先到昌平区税务局办税服务厅提交注销申请,税务人员会对相关情况进行核实处理。纳税人需要携带营业执照副本、税务登记证(若已办理 “三证合一” 则无需单独携带)、法定代表人身份证、公章等相关资料。经过税务机关审核通过后,方可完成税务注销,取得清税证明。
